Do I Need a License to Install a Pergola on My Terrace? 2026 Guide
One of the most frequent questions when buying a pergola is: do I need a building permit? The answer depends on the type of pergola, where you live, and whether your property is in a condominium.
Demountable pergola (no construction work)
Most retractable or bioclimatic aluminum pergolas are considered demountable structures that don’t require a major building permit. They attach to the floor or wall without modifying the building structure.
You normally DO NOT need a permit if:
- The pergola is aluminum and demountable
- You don’t alter the building’s load-bearing structure
- You don’t exceed the maximum dimensions of the municipal ordinance
Fixed pergola (with construction work)
A built pergola (concrete, brick, structure welded to the building) equals a construction and does require a major building permit.
You DO need a permit if:
- You build concrete pillars
- The pergola is welded or integrated into the building structure
- The surface exceeds what the local ordinance allows
Condominium communities
If you live in an apartment building, even if you don’t need a municipal permit, you do need approval from the homeowners’ association under the Horizontal Property Law (art. 7.1). A simple majority is normally required (more than 50% of votes).
Municipal ordinances in the Canary Islands
Each municipality has its own rules. Generally in the Canary Islands:
- Demountable pergolas on private terraces usually don’t require a permit
- Pergolas on facades visible from the street may require a responsible declaration
- In historic centers or protected areas, restrictions are greater

- Check your municipality’s ordinance (usually on the town hall website)
- If you live in a community, present the project at the homeowners’ meeting
- Keep the manufacturer’s invoice and specifications (they prove it’s demountable)
